We are well-equipped to handle every aspect of trust administration and litigation, including disputes over beneficial interests in trusts, the management and administration of trusts, the investment of trust assets, the management of family business after the death of a key family member, and a host of other challenges that arise in the trust arena. In the context of the administration of trust estates, the scope of our experience includes the administration of revocable living trusts prior to the death of a settlor, the administration and settlement of irrevocable trusts following the death of the settlor, including counseling both trustees and beneficiaries on their rights and obligations at every phase of the administration and settlement of a trust. Our attorneys also represent trustees and beneficiaries of charitable remainder trusts, charitable lead trusts, irrevocable life insurance trusts, generation-skipping (“dynasty”) trusts, and educational trusts. Civil Dispute Resolution & Commercial Litigation
Kipnis & Barnes represents clients in a wide variety of civil and commercial litigation contexts. We have represented financial institutions, companies, non-profit entities and individuals in jury and bench trials to verdict, in arbitration, and on appeal. While many disputes can and should be resolved at the earliest possible stages, it is nevertheless a reality of our modern commercial society that a client will need to pursue claims or defenses through trial. Cases involve commercial torts, business disputes between/among partners, statutory violations, UCC and negotiable instrument disputes, and claims arising out of brokerage and banking services. In connection with the disposition of trust and estates, the firm’s attorneys have handled all types of litigation - - both through trial and on appeal, including contests to testamentary instruments, fiduciary malfeasance and breaches of fiduciary duty, and elder abuse.
